AssetWRX Marketing Consent Policy

This policy explains how AssetWRX obtains, evidences, and respects your consent to receive marketing communications. It is written to comply with the EU GDPR, the UK GDPR, the UK Privacy and Electronic Communications Regulations (PECR), the CAN-SPAM Act (US), and Apple / Google platform policies.

1. What “marketing” means here

Communications that promote AssetWRX, suggest new features or upgrades, share tips and best practices, or offer promotions and discounts. It does not include:

• service notifications about your account (incident, security, billing, password reset);
• inspection reminders or operational alerts you have subscribed to within the product;
• legally required notices (privacy policy updates, terms changes, data-breach notification).

These transactional and required messages are sent under the contract you have with us and cannot be unsubscribed from while you have an active account.

2. How you opt in

We will only send marketing messages on a channel after you have explicitly opted in for that channel. You can opt in:

• during sign-up (a separate optional checkbox, never bundled with Terms or Privacy);
• at any time from Profile → Privacy & Data → Communication preferences;
• via the website footer if you are not yet a user.

Marketing email opt-in uses double opt-in: we send a confirmation email to the address you entered, and only after you click the link in that email do we add you to our marketing list. The confirmation link expires after 24 hours.

Marketing push opt-in uses your existing notification permission to AssetWRX. We will not send push without the in-app toggle being on AND the OS-level permission being granted.

3. How you opt out

You can opt out at any time:

• Marketing email: click the unsubscribe link at the foot of any marketing email, or toggle the relevant categories off in Profile → Privacy & Data → Communication preferences.
• Marketing push: toggle the relevant categories off in the same place, or revoke notification permission in your OS settings.
• All marketing across all channels: email privacy@assetwrx.com.

Withdrawal is recorded immediately. We will not send further marketing on the channel(s) you withdraw. It can take up to 24 hours for an already-queued send to be cancelled; we apologise in advance for any such overlap.

4. What we send

We organise marketing into three categories, each independently toggleable:

You can subscribe to any subset and over either channel (email, push).

5. Frequency and content

We aim for at most:

• one product-updates email per fortnight;
• one tips email per month;
• one promotional email per month.

We may occasionally exceed these for major launches; we’ll never spam.

6. How we evidence consent

For every marketing event we record an immutable audit row in consent_records containing the consent type, version of this policy, action (accepted / withdrawn), timestamp, server-side captured IP and user agent, and device platform. We retain these records for 7 years from the date of withdrawal so we can demonstrate, if challenged, the lawful basis of every past send.

7. Sub-processors

We use Resend, Inc. to deliver marketing emails. Resend processes your email address, the email content, and delivery metadata (open / click events where enabled). Resend acts as our processor under a data processing agreement.

8. Children

The Service is not directed to children under 16; we do not knowingly send marketing to children.

9. Changes

Material changes to this policy will be communicated as described in the Privacy Policy and will trigger a new consent prompt where required by law.
